Terms of Service

Please read these Terms carefully before using WazobiaMail. By using our platform, you agree to be bound by these conditions.

Important Reminder

WazobiaMail is an email infrastructure platform. You are solely responsible for ensuring all emails you send comply with applicable anti-spam laws and that all recipients have consented to receive your communications.

1. Acceptance of Terms

By creating a WazobiaMail account, accessing our API, or otherwise using any part of the WazobiaMail platform operated by Bonifade Technologies ("we", "us", "our"), you agree to be bound by these Terms of Service ("Terms"). If you are using WazobiaMail on behalf of a company or organisation, you represent that you have the authority to bind that entity to these Terms.

If you do not agree with any part of these Terms, you must not use our services. These Terms apply to all users, including free-tier users, paid subscribers, API consumers, and administrators.

2. Description of Services

WazobiaMail is a cloud-based email infrastructure platform that provides:

  • Transactional Email API — Send triggered emails (receipts, notifications, verification codes) via REST API or SMTP relay.
  • Email Campaigns — Create, schedule, and track bulk email marketing campaigns.
  • Mailbox Management — Create and manage sending mailboxes with custom domains.
  • Contact Management — Organise recipients into lists, groups, and segments with tagging.
  • Analytics & Reporting — Real-time dashboards for delivery rates, opens, clicks, bounces, and unsubscribes.
  • Domain Authentication — Assisted DNS setup for SPF, DKIM, and DMARC via Cloudflare integration.

We reserve the right to modify, suspend, or discontinue any part of the service at any time with reasonable notice, except in cases of emergency or legal obligation.

3. Accounts & Registration

Eligibility — You must be at least 18 years old and capable of entering into a legally binding agreement to use WazobiaMail. By registering, you represent that you meet these requirements.

Account Security — You are responsible for maintaining the confidentiality of your account credentials, including API keys. You must notify us immediately at [email protected] if you suspect unauthorised access to your account.

Accurate Information — You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

One Account Per Entity — Unless expressly permitted by us in writing, each user or organisation may maintain only one active account. Creating multiple accounts to circumvent limits, bans, or quotas is prohibited.

Account Suspension — We reserve the right to suspend or terminate accounts that violate these Terms, engage in abuse, or pose a risk to our infrastructure or other users.

4. Acceptable Use Policy

You agree to use WazobiaMail only for lawful purposes and in a manner consistent with applicable laws and regulations. The following activities are strictly prohibited:

  • Spam & Unsolicited Email — Sending unsolicited bulk email (spam) to recipients who have not explicitly opted in to receive communications from you.
  • Phishing & Fraud — Using our platform to send deceptive emails designed to steal credentials, impersonate other organisations, or conduct fraud.
  • Malware Distribution — Sending emails containing malicious links, attachments, or code.
  • Harassment — Sending threatening, abusive, or harassing content to any person or group.
  • Illegal Content — Transmitting content that is illegal in any applicable jurisdiction, including content that promotes violence, exploitation of minors, or hate speech.
  • Infrastructure Abuse — Attempting to overload, probe, scan, or exploit our systems, APIs, or network infrastructure.
  • Circumventing Limits — Attempting to bypass sending quotas, rate limits, or feature restrictions imposed by your subscription plan.
  • Reselling Without Permission — Reselling or sublicensing access to our platform without an explicit written reseller agreement with Bonifade Technologies.

We actively monitor for abuse. Violations may result in immediate account suspension and/or legal action.

5. Email Compliance & Anti-Spam

As an email infrastructure provider, we hold our users to strict compliance standards to protect the health of our shared sending infrastructure.

Consent & Opt-In — You must have explicit, documented consent from every recipient before sending marketing or bulk emails. Double opt-in is strongly recommended.

Unsubscribe Mechanism — Every marketing email you send must include a clear, functioning unsubscribe link. You must honour unsubscribe requests within 10 business days.

Sender Identification — Your emails must clearly and accurately identify you or your organisation as the sender. You may not use misleading "From" names or subject lines.

List Hygiene — You are responsible for maintaining clean mailing lists. Sending to invalid or inactive addresses that generate excessive bounces or spam complaints may result in sending restrictions.

Complaint Rate Threshold — If your spam complaint rate exceeds 0.3%, we reserve the right to throttle or suspend your sending privileges until the issue is resolved.

We reserve the right to audit your email lists and sending practices. Failure to comply with this section is grounds for immediate account termination without refund.

6. Subscriptions & Billing

Plans — WazobiaMail offers subscription plans with different sending volumes, features, and support levels. Pricing is published at wazobiamail.com/pricing and may be updated with 30 days notice.

Billing Cycle — Subscriptions are billed monthly or annually in advance, beginning on your subscription date and renewing automatically.

Payment Methods — We accept payments via Paystack (local Nigerian cards, bank transfers), Stripe (international cards), and select cryptocurrency gateways.

Cancellation — You may cancel your subscription at any time from your billing dashboard. Access continues until the end of your current billing period.

Refunds — Annual subscriptions cancelled within 14 days of purchase are eligible for a full refund. Monthly subscriptions and partial periods are non-refundable unless required by applicable law.

Failed Payments — If a payment fails, we will notify you and retry over a 7-day grace period. Unresolved failures may result in account downgrade or suspension.

Taxes — Prices exclude applicable taxes (VAT, GST, etc.). You are responsible for any taxes imposed on your use of the services.

7. Data Ownership & Licence

Your Data — You retain full ownership of all data you upload or generate through WazobiaMail, including contact lists, email templates, campaign content, and analytics data ("Customer Data").

Licence to Us — You grant Bonifade Technologies a limited, non-exclusive licence to store, process, and transmit your Customer Data solely for the purpose of providing the services. This licence terminates when you delete your data or close your account.

Our Platform — All intellectual property rights in the WazobiaMail platform are owned exclusively by Bonifade Technologies. Nothing in these Terms grants you ownership of our platform beyond the right to use it as described herein.

Feedback — If you submit feedback or feature requests, you grant us a perpetual, royalty-free licence to use them without any obligation to compensate you.

8. Service Availability & SLA

We target 99.9% monthly uptime for the WazobiaMail API and dashboard, excluding scheduled maintenance windows.

Scheduled Maintenance — We will provide at least 48 hours notice for planned maintenance. Emergency maintenance required for security may occur without advance notice.

Service Credits — If monthly uptime falls below 99.9%, eligible paid customers may request service credits:

  • 99.0% – 99.9% uptime: 10% credit of monthly fee
  • 95.0% – 99.0% uptime: 25% credit of monthly fee
  • Below 95.0% uptime: 50% credit of monthly fee

Credits must be requested within 30 days of the incident by emailing [email protected] and are your sole remedy for downtime.

9. Disclaimers & Limitation of Liability

"As Is" Service — THE WAZOBIAMAIL PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

No Guarantee of Delivery — Email delivery depends on recipient mail servers and factors outside our control. We do not guarantee inbox delivery of every email sent through our platform.

Limitation of Liability — TO THE MAXIMUM EXTENT PERMITTED BY LAW, BONIFADE TECHNOLOGIES' TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

IN NO EVENT SHALL WE BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF REVENUE, LOSS OF DATA, OR LOSS OF BUSINESS.

10. Indemnification

You agree to indemnify, defend, and hold harmless Bonifade Technologies and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in connection with:

  • Your use of the WazobiaMail platform in violation of these Terms
  • Your violation of any applicable law or regulation, including anti-spam laws
  • Your email content, contact lists, or sending practices
  • Any third-party claim that your use of the platform infringes their rights

11. Termination

By You — You may close your account at any time via account settings or by contacting [email protected]. Your data will be retained for 90 days before permanent deletion, during which you may request an export.

By Us — We may suspend or terminate your account immediately, without prior notice, if you have violated these Terms, if your account has been inactive for more than 12 months, or if required by law.

Effect of Termination — Upon termination, your right to access the platform ceases immediately. Provisions that by their nature should survive (including ownership, disclaimers, indemnification, and dispute resolution) will continue to apply.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Federal Republic of Nigeria.

Informal Resolution — Before filing any formal dispute, you agree to contact us at [email protected] and attempt to resolve the matter informally for at least 30 days.

Arbitration — Unresolved disputes shall be submitted to binding arbitration in Lagos, Nigeria, under the rules of the Lagos Court of Arbitration. The decision shall be final and enforceable.

Class Action Waiver — You agree to resolve disputes with us individually and waive any right to participate in a class action lawsuit or class-wide arbitration.

13. General Provisions

Entire Agreement — These Terms, together with our Privacy Policy, constitute the entire agreement between you and Bonifade Technologies regarding WazobiaMail.

Amendments — We may update these Terms from time to time. We will notify you of material changes at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.

Severability — If any provision is found unenforceable, the remaining provisions continue in full force.

No Waiver — Our failure to enforce any right or provision will not constitute a waiver of that right.

Assignment — You may not assign your rights under these Terms without our prior written consent. We may assign our rights without restriction.
